General

X-Sailing, operated by Dobromir Dimov, is a Training Centre registered with the Royal Yachting Association (RYA) and approved to offer RYA courses.

We draw your attention to the fact that boating is by nature unpredictable and inherently involves an element of risk. By participating in any X-Sailing course, the student:

  • Is aware of the inherent risks involved and accepts personal responsibility for those risks
  • Will comply with the instructions of RYA appointed course trainers at all times
  • Accepts responsibility for any injury or damage caused by their own negligence
  • Will not participate while impaired by alcohol, drugs, or while otherwise unfit
  • Is willing to comply with all safety requirements

X-Sailing accepts students from age 12. Students under 18 must have a signed Parent Consent Form and be accompanied by an appointed loco parentis person throughout the course.

1. Terms

All terms are for RYA or other courses as equipped and described on our website. Prices include applicable tax. The tax rate is subject to change. X-Sailing reserves the right to correct any pricing errors.

2. Acceptance

By submitting a Booking Form, you are confirming your acceptance of these Booking Conditions.

3. Booking Confirmation

A binding contract commences upon receipt of your deposit by X-Sailing. This contract is subject to Austrian law. Any disputes shall be submitted to the exclusive jurisdiction of the Courts of Austria.

4. Payment

  • A 50% deposit is due upon booking
  • The balance (remaining 50%) is payable 6 weeks before the Start Date
  • Bookings made within 6 weeks of the Start Date require full payment at the time of booking
  • Bank transfers: the customer is responsible for covering all bank charges

5. Cancellations by the Student

If you wish to cancel your booking, the following cancellation fees apply based on the notice period before the course Start Date:

  • 8 weeks or more prior to the Start Date: €250 administrative fee
  • 6–8 weeks prior to the Start Date: 25% cancellation fee of the full course fee (75% reimbursement)
  • 4–6 weeks prior to the Start Date: 50% cancellation fee of the full course fee (50% reimbursement)
  • 4 weeks or less prior to the Start Date: 100% cancellation fee of the full course fee (no reimbursement)

Cancellations are only accepted in writing (email) and are effective from the date received.

Transfer to an alternative student is possible with a €250 administration fee. You must notify X-Sailing and obtain agreement prior to any transfer. No transfers will be accepted after a cancellation notification has been issued.

We strongly recommend that you check your travel insurance policy to ensure you are covered for cancellation.

6. Cancellation by X-Sailing

X-Sailing reserves the right to cancel a course due to insufficient numbers or other operational reasons. In such cases, we will offer an alternative date or provide a full refund of all fees paid. X-Sailing shall not be liable for any consequential costs incurred by the student, including but not limited to travel, accommodation, or other expenses.

7. Events Beyond Our Control

X-Sailing shall not be liable for events beyond our reasonable control, including but not limited to: destruction or damage to the boat, mechanical breakdown, flooding or obstruction of waterways, adverse weather or tidal conditions, pandemic, natural disaster, war, terrorism, or any other force majeure event.

If a course is cancelled due to such events, X-Sailing will attempt to reschedule within 6 months. No reimbursement will be provided.

8. Shortcomings or Disputes

Any shortcomings or disputes should be notified to the Principal (Dobromir Dimov) or the Chief Instructor immediately during the course. Written details must be provided within 14 days of the course end date. X-Sailing cannot accept liability for any matter that was not raised during the course.

9. Liability

X-Sailing cannot accept liability except in cases of proven negligence by X-Sailing or its employees. Nothing in these conditions excludes or limits liability for negligence causing death or personal injury, or for breach of statutory duty.

10. Insurance

All students are recommended to take out appropriate insurance for the undertaken activity before participating in any X-Sailing course.

11. Data Protection & Privacy

X-Sailing is committed to protecting your personal data in compliance with the General Data Protection Regulation (EU) 2016/679 (GDPR), the Austrian Data Protection Act (DSG), and the Croatian Act on the Implementation of the GDPR.

What We Collect and Why

When you book a course, we collect personal information necessary to process your booking and ensure your safety:

  • Contact details (name, email, phone) — to confirm your booking and communicate course information
  • Medical declarations (health conditions, medications, allergies, swimming ability) — to assess your fitness to participate safely and to provide essential information to emergency services if needed. This is an RYA requirement for all practical courses.
  • Emergency contact details — to contact your nominated person in case of an emergency at sea
  • Sailing experience — to ensure you are placed on an appropriate course

How We Protect Your Data

All data transmitted to our website is encrypted using TLS / HTTPS. Your data is stored in an encrypted database with access restricted to the Principal only. Administrative passwords are hashed and never stored in plain text. We do not store full payment card numbers. Full details of our security measures are set out in our Privacy Policy at /privacy.

How Long We Keep Your Data

  • Booking and financial records: 7 years (Austrian and Croatian tax law)
  • Medical declarations: Duration of course + 3 years (limitation period)
  • RYA certificates: Held indefinitely (also registered with the RYA centrally)
  • Contact enquiries: 2 years, then deleted

Who We Share Your Data With

We do not sell your data. Your details are shared only where necessary:

  • The RYA — via their secure Certificate Registration Hub, for issuing official certificates on completion of practical courses
  • Emergency services — medical information may be shared with coastguard, rescue, or medical professionals in an emergency
  • Tax authorities — financial records as required by law

Your Rights

Under GDPR, you have the right to access, correct, or delete your personal data, to restrict or object to processing, and to withdraw consent at any time. 12. Medical Declaration

All participants are required to complete a medical declaration form as part of the booking process. This is an RYA requirement for all practical sailing courses. The declaration asks about:

  • Any medical conditions that may affect your ability to participate safely
  • Current medications
  • Allergies
  • Swimming ability

This information is used solely to assess your fitness to participate and to ensure your safety during the course. It is stored securely, accessible only to the Principal and your course instructor, and is retained for the duration of the course plus 3 years (the statutory limitation period for personal injury claims). Your medical data will only be shared with emergency or medical services if required for your safety.

13. Course Content

X-Sailing offers RYA courses, mile-building passages, and skippered holidays. X-Sailing reserves the right to amend course content where necessary. All boats used are RYA registered and approved.

Courses include:

  • Experienced RYA instructor tuition
  • Chief Instructor oversight
  • 5–6 days of tuition
  • Accommodation as agreed
  • Freshly laundered bedding and towels
  • Waterproofs
  • Food and drink while sailing
  • Mooring fees, diesel, and gas

Not included:

  • Flights and travel to/from the marina
  • Travel insurance
  • Evening meals ashore
  • RYA examination fees

14. Completion

X-Sailing maintains high standards of instruction. RYA certificates will not be issued if, in the opinion of the instructor, the student has not reached the expected standard of competence.

17. Complaints Procedure

X-Sailing operates a formal complaints procedure in accordance with RYA Recognition Guidance Notes (RGN B13). All students, guests, and participants have the right to raise a concern or complaint at any stage of their course, booking, or experience with X-Sailing.

Our complaints procedure is three-tiered:

Step 1 — Speak directly with your instructor

For immediate informal resolution. Most concerns can be resolved promptly on the spot.

Step 2 — Contact the Principal

If the matter is not resolved, contact the Principal (Dobromir Dimov) directly:

Step 3 — Formal written complaint

If the matter remains unresolved, you may submit a formal written complaint to:

Escalation to the RYA

If you are not satisfied with the outcome, you have the right to escalate your complaint to the Royal Yachting Association (RYA) at any time:
